Special Needs Trusts

Individuals and family members who want to provide for a developmentally disabled child or adult or other incapacitated family member will benefit from special needs planning. A special needs trust will allow the beneficiary to receive distributions from the trust without losing eligibility for governmental benefits. A special needs trust is usually created by a parent, grandparent, guardian or other relative and can be an extremely effective estate planning tool. There are two types of special needs trusts:

  • Self settled special needs trust (first party trust).
  • Third party special needs trust.

A special needs trust can be created through your Will (to become operative upon your death) or during your life. If a special needs trust is created during your life, assets can be added to the trust throughout your lifetime. If a special needs trust is created through your Will, it can be funded by assets of your estate and life insurance.
